Entity: MariqueCalcus Ltd, trading as StayHawk (“Company,” “we,” “us,” or “our”)
1. Overview
StayHawk subscriptions are billed on a recurring basis (monthly or annually). All payments are processed by Paddle.com Market Limited (“Paddle”), which acts as our Merchant of Record. This means Paddle is the seller of record for all transactions, handles payment processing, invoicing, sales tax, and VAT on our behalf.
Because Paddle is the Merchant of Record, this refund policy aligns with Paddle’s Terms of Service. In the event of any conflict between this policy and Paddle’s terms regarding refund processing, Paddle’s terms shall prevail.
2. Cancellation
2.1 How to Cancel
You may cancel your subscription at any time from the Settings page in your StayHawk dashboard by clicking “Manage Billing.” This opens the Paddle customer portal where you can cancel your subscription directly.
2.2 What Happens After Cancellation
When you cancel, your subscription remains active until the end of your current billing period. You will not be charged again. After the billing period ends, your workspace will be downgraded to the Free plan with reduced booking limits.
Your data is retained after downgrade. You can continue to view existing bookings on the Free plan, subject to Free-tier limits. If you wish to delete your data, you may do so from the Settings page or by contacting us.
3. Refunds
3.1 14-Day Refund Policy
If you are not satisfied with StayHawk, you may request a full refund within fourteen (14) days of your initial subscription purchase or renewal. No reason is required.
3.2 Requesting a Refund
To request a refund, email support@stayhawk.app with your account email address. We aim to process refund requests within five (5) business days.
4. How Refunds Work
4.1 Processing
Approved refunds are processed by Paddle and returned to the original payment method. Refund processing times depend on your payment provider and may take five (5) to ten (10) business days to appear on your statement.
4.2 Currency and Amounts
Refunds are issued in the original transaction currency. Due to exchange rate fluctuations, the refunded amount in your local currency may differ from the original charge. StayHawk is not responsible for any difference caused by currency conversion.
4.3 Taxes
Because Paddle handles tax collection as Merchant of Record, any applicable tax refunds are processed by Paddle in accordance with local tax regulations.
5. Plan Downgrades
If you downgrade your subscription (e.g., from Agency to Pro), the change takes effect at the start of your next billing cycle. You retain access to your current plan’s features until that date.
6. EU/EEA Consumer Rights
6.1 Right of Withdrawal
If you are a consumer residing in the European Union or European Economic Area, you have the right to withdraw from your purchase within fourteen (14) days of the transaction without giving any reason, in accordance with the Consumer Rights Directive (2011/83/EU).
6.2 Mandatory Consumer Protections
Nothing in this policy limits any rights you may have under mandatory consumer protection laws in your country of residence, including but not limited to statutory guarantees of conformity. Where mandatory local law provides greater refund rights than this policy, those rights apply.
